EVENITO AG GENERAL TERMS AND CONDITIONS 

General Terms and Conditions of Participation for Attendance at the Event
 

Status: 4/4/2022, 4:15 p.m.

1. General

1.1. These General Terms and Conditions ("GTC") apply to participation in the Herrenknecht Gala 2022, hosted by Herrenknecht AG. 

1.2. The organizer reserves the right to make changes and additions to these provisions. Any changes and additions shall become valid upon publication on this website.

2. Performance

2.1. The scope of the contractual performance in connection with the event is derived from the information documents, the details on the event website, any existing registration forms and the confirmation of participation by the organizer. 

2.2. Travel to and accommodation at the event are not included in the event offer. 

3. Cancellation of the event 

3.1. The organizer may cancel the event with a reasonable period of notice. In addition, the event can be canceled at short notice for compelling or urgent reasons. Any costs incurred in reliance on participation in the event (e.g. travel and accommodation costs) will not be reimbursed.

4. Copyright and other rights 

4.1. The presentations and event elements are protected by copyright and may only be used for personal use. Rights of use shall only be transferred by express written granting of rights of use. Duplication, distribution, processing or public reproduction of any kind is not permitted and requires the written consent of the organizer.

4.2. Audio and video recordings and descriptions of the event or the event outcomes, in whole or in part, are not permitted. 

5. Visuals/photographs

5.1. Participants at the event agree irrevocably and free of charge that the organizer is entitled to create, reproduce, broadcast or have broadcast photographs, video and/or audio recordings of their person that go beyond the reproduction of a current event, as well as to use them in audiovisual media.

6. Liability 

6.1. The organizer shall be liable

  • For any breach of fundamental contractual obligations for intent and any negligence. Liability shall be limited to the amount paid by the participant; liability for consequential damage and financial loss (e.g. loss of profit) is excluded

6.2. These limitations and exclusions of liability shall not apply to

  • Claims due to fraudulent conduct of a contractual partner;
  • Claims arising from liability for guaranteed characteristics;
  • Damages resulting from injury to life, body or health. 

6.3. Furthermore, the organizer and their vicarious agents shall not be liable for disruptions of any kind caused by circumstances beyond their control. 

6.4. Liability for damage incurred during travel to and from the venues, as well as for losses and accidents, is excluded to the extent permitted by law.

7. Compliance 

7.1 Participants shall establish whether there are any notification, approval, publication or release obligations due to applicable service regulations, transparency rules or internal compliance guidelines and shall fulfill these obligations on their own responsibility.

7.2 The event is not intended to influence the professional independence of the participants. If there is any concern on the part of an invitee that participation in the event could trigger conflicts of interest or inappropriately influence the decision-making process in a business context, these concerns must be disclosed transparently and, where applicable, the invitee must refrain from participating in the event.

8. Final provisions 

8.1. The laws of the Federal Republic of Germany shall apply exclusively. 

8.2. Should individual provisions of this contract be invalid or lose their validity due to a circumstance occurring at a later date, the validity of the rest of the contract shall remain unaffected. The invalid contractual provisions shall be replaced by a provision that comes as close as possible to what the contracting parties would have intended if they had considered the point in question. The same shall apply to loopholes in this contract. 

8.3. The place of performance is the registered office of the organizer
